UNITED STATES BANKRUPTCY COURT FOR THE DISTRICT OF ALASKA
605 West 4th Avenue, Room 138, Anchorage, AK 99501-2296 (Phone 907/271-2655)

In reCase No. 3-86-00105-HAR
 Chapter 7
TROY L. BOWERS,
ORDER FOR REOPENING OF CASE AND
Debtor(s)     APPOINTMENT OF TRUSTEE

Daerim America, Inc., filed a motion to reopen this case and appoint a trustee. Although Daerim is not a creditor, if the allegations in the motion are true, there may be assets that have escaped administration due to an alleged failure to schedule corporate shares Daerim claims he owned or an interest in a lawsuit. These potential assets may have not been abandoned when the trustee filed a no asset report and the case was closed. Compare In re Pace, 132 BR 644, 2 ABR 54 (Bankr.D.AK 1991) and Vreugdenhill v. Navistar Int'l Trans. Corp., _____ F2d _____, 1991 WL 249734 (8th Cir. 1991) (stating that failure to formally schedule a lawsuit, even if disclosed to the trustee, did not result in an automatic abandonment under 11 USC § 554(c)). Therefore,

TOP    2 ABR 205
IT IS ORDERED that this case be reopened (provided Daerim pays the fee for reopening) and that the U.S. Trustee appoint a trustee.

DATED: December 5, 1991.
 BY ORDER OF THE COURT
