A trial was held on May 14, 1990. The court ruled for the defendant in large part. Ann Rhian, defendant's counsel, was to draft a judgment, but she passed away. Therefore, the court is preparing the form of judgment.
IT IS ORDERED that plaintiff have judgment against the estate for the sum of $3,100.00 for the purchase of the 1969 GMC truck, SN EMV0VC20919, plus $2,347.00 for repair of that truck provided that the truck, in substantially the same condition as repaired by plaintiff, be returned to the defendant by the plaintiff. Of the total sum of $5,447.00 to be paid from the 2 ABR 40 estate upon the return of the truck, the court may surcharge the trustee's fees in the main case for the $2,347.00 at the final account.
